Terms and Conditions of Use
Our policy on protecting your personal information helps establish a relationship of trust between you and our services, to offer you a positive experience with complete transparency.
Thanks to this policy, we can take your needs into account and live up to your expectations.
To honour your trust, Argomatw LLC, which operates the Demeuria brand, makes it a priority to respect your personal information and to keep our customers' information confidential (hereinafter, "your information").
To be fully transparent with you and to guarantee you safe use of our site demeuria.com in all its available versions and in the related applications (hereinafter, the "Demeuria Site"), we explain how we process your information, so that our services always respect your rights. In this way, we protect your privacy and guarantee the security, confidentiality and integrity of your information on all our platforms.
Through this policy, we guarantee that all necessary precautions are taken to protect your information and to prevent its disclosure, loss or alteration. For this reason, we give you everything you need to easily understand how we process your information. This information will be kept only for as long as necessary for the intended management and processing. You can of course access and change your information at any time, as it will be available in your personal area of the Demeuria Site.
To this end, we undertake to adopt all measures necessary to comply with the applicable rules on the protection of personal information.
Therefore, with this personal information protection policy, Demeuria undertakes to respect the essential principles of the Personal Information Protection and Electronic Documents Act (PIPEDA) and of the applicable provincial laws, by making available to you information on the existence and methods of the processing applied here (section 2) and on the rights you have over your information, and by honouring these rights itself (section 5). All information on any transfers to a country outside Canada or to recipients (sections 3 and 7), on the retention period of the information collected (section 4) and on security measures (section 8) is also made available to you.
1. WHO ARE YOU?
When we speak to "you" in this Personal Information Protection Policy, it is simply because it concerns you directly: as a Demeuria customer if you placed an order on the Demeuria Site, as a Demeuria customer if you created a customer account without ordering products or services, or as a visitor if you browsed the Demeuria Site without creating a customer account or placing an order.
2. FOR WHAT PURPOSES DO WE PROCESS YOUR INFORMATION?
2.1. When do we collect your personal information?
Your personal information may be collected if you visit the Demeuria Site, which uses cookies, if you create a customer account on the Demeuria Site, if you order one of our products or services, or if you have agreed to subscribe to our newsletters (text message, email).
We use your personal information to make your browsing on the Demeuria Site smoother and to offer you a more personalized experience. This way, we can better manage your orders, offer payment in instalments, prevent fraud, issue any necessary refunds and manage customer reviews.
2.2. Your browsing on the Demeuria Site
To allow you to browse the Demeuria Site, we process your information on the legal basis of your consent.
2.3. Managing your orders
We use your information to take care of your orders and manage them.
We use it to manage mediation, customer relations (including through social networks), our after-sales and distance-selling service and our marketing and commercial prospecting activities for the Demeuria Site, as well as for the management, delivery and transport of orders.
The performance of the contract between the two parties (you and us) is the legal basis for processing this information.
Demeuria's legal obligation is the legal basis for processing with respect to the management of product recalls. Your consent or our legitimate interest is, as the case may be, the legal basis for processing for marketing and commercial prospecting activities. Your consent is the legal basis for activating "quick" payment.
2.4. Payment in instalments
For orders that provide for payment in instalments, and for certain customers, your information is processed so that we can offer you this type of payment. The performance of the contract between the two parties is the legal basis for processing the information. However, your consent remains the basis for processing your banking information.
2.4.1. Klarna
To offer you Klarna payment options, we may need to send Klarna your personal information, including your contact information and the details of your order, so that Klarna can assess whether you meet the requirements to use them and adapt them to your needs. The personal information transferred will be processed in accordance with Klarna's privacy policy.
2.5. Customer reviews
To share your reviews with our customers and visitors and to allow you to leave your review on the Demeuria Site, we use your information on the legal basis of your consent or of our legitimate interest.
2.6. Payment collection and fight against fraud
We use your information to allow the collection of payments and the fight against fraud.
This also allows us to guarantee the security of payments. The performance of the contract between the two parties and the legitimate interest of Demeuria, as the party responsible for processing, are the legal bases for this processing.
2.7. Demeuria's advertising management activities
Demeuria's advertising activities are managed through the use of your information.
This allows us to expand our information on customers and potential customers, to manage maintenance and technical activities relating to potential customers, sales statistics and studies on advertising campaigns, the updating of prospecting lists with the body responsible for managing advertising exclusion systems, commercial communications, and the organization of our contests and draws or any other promotional initiative, excluding online gambling.
The legal bases for the above are the user's consent or the legitimate interest of Demeuria.
3. WHERE DOES YOUR INFORMATION GO?
Your information is sent to various internal departments of Demeuria.
It is not sent to third parties, except in the situations described below:
To manage your orders, your personal information may be sent to various providers specializing in banking transactions, customer relations, after-sales service, delivery, software development, site management, or the provision of warranties or insurance.
For payment in instalments, your information may be shared with providers such as payment and transaction centres (banks, etc.), call centres for the management of business processes or the customer experience or, for reviews, with a provider that manages the collection and processing of customer reviews.
Demeuria's advertising activity is managed, using your information, with clients of an advertising agency and with advertisers.
4. RETENTION OF INFORMATION
The information collected by Demeuria is kept only for as long as necessary to carry out the activities described in section 2 of our personal information protection policy.
We keep certain information collected by Demeuria for a certain period.
For potential customers, it is kept in an active archive for 3 years from the last contact (it can therefore be consulted by Demeuria's departments). We do not keep this information in an intermediate archive (for information of administrative interest to certain departments, such as litigation, the retention periods are set according to the applicable limitation rules).
With respect to our orders, your information will be kept in an active archive for 5 years from the end of the processing of the customer's orders, and in an intermediate archive for 5 years from the end of retention in the active archive. The same applies to customers.
Banking information is kept in an active archive for the full validity period of the payment card (plus one day). Banking information is not kept in an intermediate archive.
Cookies, their use and their duration are described in section 6 of our policy.
5. EXERCISING YOUR RIGHTS
5.1. You have the right to request access to your information and its modification and correction.
5.2. You have the right to request that the processing of your information be limited.
Important note: you can do so in the following cases: if you dispute the accuracy of your personal information, for the time we need to verify its accuracy; if you believe that our use of your personal information is unlawful and you request a limitation of its use rather than its deletion; when we no longer need your information for the purposes described in section 2, but your information is still useful for establishing, exercising or defending your rights in court; or if you decide to exercise your right to object, for the time needed to verify whether the legitimate grounds we are pursuing prevail over yours.
5.3. You have the right to request the deletion of your information.
If you request the deletion of your personal information, Demeuria may still keep it in an intermediate archive for as long as necessary to meet its legal, accounting and tax obligations.
5.4. You have the right to object to processing carried out for commercial prospecting purposes.
In the case of email prospecting, you can request a change to the newsletters or unsubscribe from them by clicking the "unsubscribe" link in every newsletter, or by going directly to the contact page of the Demeuria Site.
In the case of text message prospecting, you can unsubscribe by sending a text message with the word "STOP", or by going to the contact page of the Demeuria Site.
5.5. You have the right to give instructions for the period after your death regarding the retention, deletion and disclosure of your personal information.
In the absence of such instructions, your successors and heirs may contact Demeuria to access this information in order to "organize and settle the estate of the deceased" and/or close the account on the site and/or request that the processing of the personal information stop.
You may also request that your information not be disclosed to third parties in the event of your death.
5.6. You have the right to the portability of your information.
5.7. You have the right to withdraw your consent to processing based on it.
Important note: withdrawing your consent does not affect the lawfulness of processing carried out before the withdrawal.
5.8. You have the right, at any time, to file a complaint with the competent supervisory authority (in Canada, the Office of the Privacy Commissioner of Canada: www.priv.gc.ca; in Quebec, the Commission d'accès à l'information: www.cai.gouv.qc.ca).
To exercise your rights, send your request (with your email address, first name, last name, a copy of your identification and your mailing address) to Demeuria's privacy officer by email at contact@demeuria.com and/or by mail to the following address:
Argomatw LLC, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States
We will reply within a maximum of thirty (30) days from the date of receipt of the request.
6. COOKIES
6.1. What is a cookie?
When you browse a site like Demeuria's, the site may, depending on your choice, save a text file on your device (computer, phone or tablet) through your browser.
This text file is called a COOKIE. During the period the cookie is valid or saved, the cookie allows a site like Demeuria's to recognize the device you are using when you visit again.
Only the party that issued a cookie can read or change the information it contains.
6.2. What are cookies used for on Demeuria?
Cookies can be classified into different categories. Some are issued directly by Demeuria and its providers, others sometimes come from third-party companies.
6.2.1. Cookies issued by Demeuria and its providers
There are different categories of cookies that may be on your device when you browse our site:
6.2.1.1. "Essential" cookies
"Essential" cookies are needed to access our site; they are used, for example, to place an order.
Without them, you may have problems browsing the site and may not be able to place an order.
"Essential" cookies also allow Demeuria to monitor its own activity. They may be installed on your device by Demeuria or its providers.
6.2.1.2. "Analytics and Personalization" cookies
"Analytics and personalization" cookies are not mandatory: they allow us to make your searches easier, optimize your experience with us, better understand your expectations, adapt our offers and improve the organization of our site.
6.2.1.3. "Advertising" cookies
Advertising cookies are linked to the ads displayed in the spaces of our site reserved for advertising. The benefit for you is better, optimized browsing thanks to relevant offers and ads.
For this purpose, "advertising" cookies identify your expectations in real time and offer you advertising content suited to your wishes and interests of the moment, based on your recent browsing history on other sites.
This avoids showing you advertising content that does not interest you. At the same time, Demeuria prefers its offers and ads to be shown to users who may be interested in them.
The advertising content offered may contain cookies issued by Demeuria, its providers or third parties, when a cookie is linked to an advertiser's advertising content.
6.2.2. Cookies issued by third-party companies
Third parties that use cookies on our site apply their own privacy policy. These cookies are not needed to use our site.
6.2.3. Cookies issued by third-party applications integrated into our site
While you browse, we may integrate third-party software applications into our site to give you the option of sharing content and/or your opinion from our site with other people, for example when you click the "share" or "like" buttons of social networks.
Through these buttons, social networks can identify you even if you did not use them while browsing the site. They can do this if, during your last visit to the site, you were at the same time logged in or active on your social network from your device. We have no control over how they use these buttons or over the information they hold.
To learn more about the use of your information and about advertising content, you can read the personal information protection policies of your social networks. These policies should allow you to manage your settings according to your preferences in your account on each social network you are registered with.

With regard to our advertising activity, we remind you, as stated above, that all our advertising spaces may contain third-party cookies (the advertiser behind the ad shown, the advertiser's third-party providers, etc.).
With these cookies, and during their period of validity, these parties can therefore show ads in the spaces reserved for third-party advertising, count the number of content items they offer in our spaces, and learn the size of the audience for these ads and the number of clicks; this allows them to claim the sums owed to them and produce their own statistics. They can also learn that your device previously visited another site containing one of their ads and, therefore, target you and personalize their content accordingly.
6.3. The options offered by your browser (Firefox, Google Chrome, Safari, etc.)
Your browser has many options that you can set according to your preferences. In this way, you can accept or refuse cookies on your device.
However, if you choose to accept the saving of these cookies, during your visits to sites or content that use them, the cookies will be saved automatically on your device.
According to your preferences, you can choose to turn on an alert that asks whether you accept or refuse cookies before they may be saved, or refuse the saving of cookies on your device each time.
It is important to note that the choices you make with these settings may change or affect your browsing on the Internet or on certain sites or services that require the use of these cookies (for example, to place an order on our site).
If you prefer to refuse these cookies or to delete those already saved, we accept no responsibility for the consequences for the operation of our services resulting from our services being unable to save or access the cookies needed for them to work.
6.3.1. How do you choose your options according to your browser?
You have different options depending on your browser. To learn more, you can consult your browser's help menu.

7. TRANSFERS OUTSIDE CANADA
Because Demeuria is operated by Argomatw LLC, a company organized under United States law and based in the United States, some information may be processed outside Canada, in particular in the United States. When our providers are located outside Canada, we share some of your information with them.
In this case, we do what is necessary so that the information is shared in accordance with the applicable rules and so that your privacy and your fundamental rights are protected.
The privacy officer can, at your request, give you more information about the transfer of the information.
8. SECURITY MEASURES
With the technical and organizational measures we adopt, we can guarantee a level of security appropriate to the risks to the rights and freedoms of individuals in relation to the processing described in section 2. For this purpose, we take into account the origin, scope and context, the costs and the state of the art, the purposes of the processing, and also the risks identified.
In addition, we comply with the PCI DSS payment card industry security standard, as a sign of our commitment to security.
9. PROFILING AND AUTOMATED DECISIONS
The automated processing we use (for example, profiling) may have legal effects that concern you.
All of this is essential to the conclusion or performance of the contract between us.
This is how we can offer and carry out the automated identification of customers and "payment in 4 instalments". This process is based on the analysis of various variables relating to the type of products, the services ordered or the customer's profile.
If the risk assessed with these statistics is too high (fraud/non-payment), this payment method will not be offered.
However, if you wish, you can obtain human intervention even if the decisions are automated: you can then express your opinion and/or challenge the automated decision.
10. UPDATE AND REVIEW OF THE POLICY
Our personal information protection policy will be updated whenever necessary to remain in line with the rules that apply to the protection of your information (at least every three (3) years).
